Terms of Service

These Terms govern your use of Hypercreator ("the Service"), operated by DarkRhino, a sole trader based in England and Wales. By creating a workspace or using the Service you agree to these Terms.
1. What the Service is
Hypercreator is workstation software for content creators and their teams: a unified inbox, fan relationship tools, AI-assisted message drafting, content send tracking, mass messaging and team management for accounts you hold on third-party platforms ("Platforms"). Hypercreator is not affiliated with, endorsed by, or partnered with OnlyFans.com, Fansly, Fenix International Limited, or any Platform. We do not host, publish, or distribute adult content; we provide software that helps you manage accounts you own.
2. Your accounts and authority
You may only connect Platform accounts that you own or are explicitly authorised to operate. You are responsible for your conduct on the Platforms, for compliance with each Platform's own terms, and for the actions of team members you invite into your workspace. Connecting an account you are not authorised to operate is a material breach of these Terms.
You acknowledge that Platforms may object to third-party tooling and that use of the Service is at your own risk with respect to Platform enforcement, including account restriction or termination. We make no promise that use of the Service is undetectable or risk-free, and we are not liable for Platform actions against your accounts.
3. AI features
The Service can draft messages using artificial intelligence. Drafts are suggestions: a human operator reviews and sends them. You are responsible for every message sent from your connected accounts, whether typed or drafted by AI. You must not represent AI-drafted messages as prohibited by, or use them in violation of, an applicable Platform's rules on your account.
4. Fees
Paid plans are billed per connected creator account. Pricing is revenue-indexed: your tier is derived from a connected account's trailing 30-day gross earnings as reported by the account's Platform data, evaluated at each billing cycle boundary — never mid-cycle. We retain the earnings snapshot used for each tier decision. Fees are non-refundable except where required by law. We may change pricing with at least 30 days' notice.
5. Acceptable use
Use of the Service is subject to our Acceptable Use Policy, which is part of these Terms. We may suspend or terminate workspaces that breach it, with immediate effect for serious violations.
6. Your data
Our Privacy Policy describes what we store and why. You retain all rights to your content and fan relationships; you grant us the licence needed to operate the Service (mirroring conversations, generating AI drafts, computing analytics) and nothing more.
7. Availability and liability
The Service is provided "as is". We work to keep it reliable, but we do not guarantee uninterrupted availability, and third-party dependencies (Platforms, payment processors, AI providers) may fail outside our control. To the fullest extent permitted by law, our total liability arising out of the Service is limited to the fees you paid us in the three months preceding the claim. Nothing in these Terms limits liability that cannot be limited under the law of England and Wales.
8. Termination
You may close your workspace at any time; billing stops at the end of the current cycle. We may terminate for breach of these Terms or the AUP. On closure we delete mirrored conversation data within 30 days, except records we must keep for legal or accounting purposes.
9. General
These Terms are governed by the law of England and Wales, and its courts have exclusive jurisdiction. We may update these Terms; material changes will be notified in-app at least 14 days before taking effect. Questions: legal@hypercreator.co.
